Photo Use Agreement

I hereby grant to Wichita State University (“WSU”) the full and complete right to possess any digital photographs (“Photographs”) that I upload to this site.

By signing this agreement, I understand that

• WSU has the right to determine how the Photographs are used;
• WSU will be able to use the Photographs forever;
• WSU is not required to use the Photographs; and
• I will not receive any compensation, including royalties, for the use of the Photographs.

By signing this agreement, I am agreeing that:

• I own the Photographs;
• I have the right to allow WSU to use the Photographs;
• I do not need the consent of anyone else before allowing WSU to use the Photographs;
• No one, including WSU, has given me anything of value in exchange for using the Photographs; and
• No one, including WSU, has promised me anything in exchange for using the Photographs.

I hereby release and forever fully discharge WSU, its members individually, and its officers, agents, licensees, and employees from any and all claims, demands, liability, rights and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have arising from or related to this agreement or WSU’s use and/or future use of the Photographs, including but not limited to all claims for defamation, libel, invasion of privacy, or infringement of rights of copyright and publicity.

This agreement and all matters or issues related to this agreement shall be governed by the laws of the State of Kansas without regard to the conflicts of law provisions thereof and any claim arising under this agreement shall be resolved in the courts located in Sedgwick County, Kansas.
